What is Juvenile Court?
Juvenile Court can be divided into two separate and distinct types of proceedings; Juvenile Delinquency & Dependency. The stated goal in both types of juvenile proceedings is to rehabilitate juveniles and/or their parents. As compared to adult court proceedings, juvenile proceedings are often much more informal and may rely on a court appointed Hearing Master to make decisions rather than an elected Judge.
What is a Juvenile Delinquency Proceeding?
Juvenile Delinquency proceedings occur when a juvenile is accused of something that would constitute a crime if they were an adult. Rather than being classified as crimes, these offenses are classified as delinquent acts and rather than the District Attorney's office filing a criminal complaint, they may file what is called a petition to adjudicate the child delinquent.
While is adult court the Commonwealth need only prove that a person committed a crime, in juvenile court the Commonwealth must prove not only that but that the juvenile is also in need of rehabilitation.
